Before going to federal court to win a right to Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits, a claimant must first exhaust the appeals system within Social Security. Those levels are:
- Reconsideration (or Disability Redesign Prototype if you live in Alabama, Alaska, California - Los Angeles area, Colorado, Louisiana, Michigan, Missouri, New Hampshire, New York, and Pennsylvania)
- Administrative Law Judge
- Appeals Council
The rules in Federal Court are beyond the current scope of this site. For more information, contact a lawyer with experience in handling claims involving Social Security Disability Insurance. See Locating An Attorney.
